Welcome to Tiffinshala ("Tiffinshala", "we", "our", or "us"). These Terms & Conditions ("Terms") govern your access to and use of the Tiffinshala website, mobile applications, and any related products, features, or services (collectively, the "Platform").

By accessing or using the Platform, you acknowledge that you have read, understood, and agree to be bound by these Terms, our Privacy Policy, and any other policies published on the Platform from time to time.

If you do not agree with these Terms, you must immediately discontinue your use of the Platform.

Tiffinshala is a technology-enabled hyperlocal business discovery, directory, and lead generation platform that helps users discover, compare, and connect with trusted local businesses and service providers.

The Platform currently facilitates the discovery of businesses including, but not limited to:

• Home Chefs
• Tiffin Services
• Meal Providers
• Cloud Kitchens
• Caterers
• Paying Guest (PG) Accommodations
• Hostels
• Mess Services
• Other local businesses and services that may be introduced from time to time.

Tiffinshala provides a digital platform where users can browse business listings, view business information, compare available options, and directly contact business owners using the contact details made available on the Platform.

Unless expressly stated otherwise, Tiffinshala does not own, operate, manage, employ, supervise, inspect, certify, endorse, franchise, control, or guarantee any business listed on the Platform.

Tiffinshala does not prepare or sell food, provide accommodation, process bookings, collect payments on behalf of businesses, provide delivery or transportation services, or act as an agent, broker, employer, franchisee, or representative of any listed business.

Our role is strictly limited to providing technology services that facilitate business discovery, visibility, and direct communication between users and independent business owners.

The inclusion of any business on the Platform should not be interpreted as an endorsement, certification, recommendation, warranty, or guarantee of that business, its products, services, pricing, safety, hygiene, legality, quality, or suitability.

Tiffinshala may introduce additional categories of businesses, products, services, or Platform features in the future. Unless expressly stated otherwise, these Terms shall automatically apply to all current and future categories available on the Platform.

For the purposes of these Terms & Conditions, unless the context otherwise requires, the following terms shall have the meanings assigned below:

"Business" means any individual, sole proprietor, partnership, company, organization, establishment, institution, or other entity that offers products, accommodation, food, services, or other offerings and is listed or displayed on the Platform. This includes, but is not limited to, home chefs, tiffin services, meal providers, cloud kitchens, caterers, Paying Guest (PG) accommodations, hostels, mess services, and any other business categories introduced by Tiffinshala from time to time.

"Business Owner" means the owner, operator, manager, authorized representative, employee, or any person acting on behalf of a Business listed on the Platform.

"Business Listing" or "Listing" means any profile, page, advertisement, business information, contact information, photographs, menu, pricing, accommodation details, amenities, reviews, ratings, or any other content relating to a Business displayed on the Platform.

"Platform" means the Tiffinshala website, mobile applications, software, APIs, tools, features, communication channels, and any other digital services operated by Tiffinshala.

"User" means any individual or entity who visits, accesses, browses, registers, interacts with, or otherwise uses the Platform, whether as a customer, business owner, visitor, or in any other capacity.

"Content" means all text, graphics, images, logos, trademarks, menus, pricing information, accommodation details, photographs, videos, reviews, ratings, comments, software, databases, documents, designs, layouts, and any other information or material available on or through the Platform.

"User Content" means any information, review, rating, photograph, video, comment, feedback, listing details, business information, or other content submitted, uploaded, published, transmitted, or otherwise made available by a User or Business Owner through the Platform.

"Public Information" means information that is lawfully available through publicly accessible sources, including but not limited to official business websites, Google Business Profiles, public business directories, social media business pages, government records, advertisements, promotional materials, or other publicly available sources.

"Lead" means any enquiry, phone call, message, contact request, website visit, WhatsApp conversation, email, or other interaction initiated by a User with a listed Business through or as a result of the Platform.

"Services" means the technology services provided by Tiffinshala, including business discovery, business listings, search functionality, lead generation, business visibility, communication facilitation, and any other current or future features made available through the Platform.

"Applicable Laws" means all laws, rules, regulations, governmental orders, judicial decisions, statutory provisions, and regulatory requirements applicable to the use of the Platform, the Business, or these Terms.

References to the singular shall include the plural and vice versa, references to one gender shall include all genders, and headings are provided solely for convenience and shall not affect the interpretation of these Terms.

By accessing or using the Platform, you represent and warrant that:

• You are at least 18 years of age or have the legal capacity to enter into a binding agreement under the applicable laws of your jurisdiction.
• You have read, understood, and agree to comply with these Terms, our Privacy Policy, and any other policies published on the Platform.
• You will use the Platform only for lawful purposes and in accordance with these Terms.
• Any information provided by you to Tiffinshala is true, accurate, complete, and up to date.
• Your use of the Platform does not violate any applicable law, regulation, contractual obligation, or the rights of any third party.

If you access or use the Platform on behalf of a Business, company, partnership, organization, or any other legal entity, you represent and warrant that you are duly authorized to act on behalf of such entity and to bind it to these Terms. In such cases, references to "you" shall include both the individual accessing the Platform and the entity they represent.

Tiffinshala reserves the right, at its sole discretion, to refuse access to the Platform, suspend or terminate accounts or listings, or restrict the use of any part of the Platform if it believes that a User has violated these Terms, provided false or misleading information, engaged in fraudulent or unlawful activities, or otherwise acted in a manner that may harm the Platform, its Users, or listed Businesses.

Your continued access to or use of the Platform following any updates to these Terms constitutes your acceptance of the revised Terms.

Tiffinshala is a technology-enabled hyperlocal business discovery, directory, and lead generation platform.

The Platform is designed to help Users discover, compare, and connect with independent Businesses by providing business listings, search functionality, publicly available information, business-submitted information, and communication channels.

Tiffinshala acts solely as an intermediary technology platform that facilitates the discovery of Businesses and enables direct communication between Users and Business Owners. Tiffinshala does not act as an agent, broker, franchisee, employer, representative, partner, or joint venture of any listed Business.

Unless expressly stated otherwise, Tiffinshala does not:

• Own, operate, manage, or control any listed Business.
• Prepare, manufacture, package, sell, or deliver food or beverages.
• Own, lease, rent, manage, operate, inspect, or provide accommodation facilities.
• Process bookings, reservations, or rental agreements.
• Process or collect payments on behalf of Businesses.
• Negotiate or enter into contracts between Users and Businesses.
• Employ or supervise staff, delivery personnel, or representatives of listed Businesses.
• Verify, inspect, audit, certify, or continuously monitor the quality, safety, hygiene, legality, licensing, pricing, availability, or suitability of any Business, product, accommodation, or service.
• Guarantee the availability, performance, reliability, or quality of any Business listed on the Platform.

All interactions, enquiries, communications, negotiations, bookings, purchases, rentals, payments, deliveries, refunds, cancellations, agreements, and disputes occur solely between the User and the respective Business.

Tiffinshala is not a party to any transaction, agreement, contract, booking, rental arrangement, purchase, payment, or other relationship established between a User and a Business.

Users are solely responsible for conducting their own due diligence before engaging with any Business. This includes independently verifying information such as pricing, availability, food quality, accommodation standards, amenities, hygiene, safety, licenses, certifications, business registrations, refund policies, cancellation terms, occupancy rules, and any other information relevant to the products or services offered.

The inclusion of a Business on the Platform does not constitute or imply any endorsement, recommendation, certification, accreditation, guarantee, warranty, partnership, sponsorship, or approval by Tiffinshala.

Businesses operate independently of Tiffinshala and remain solely responsible for their operations, products, services, communications, representations, statutory compliance, customer support, and all obligations arising from their dealings with Users.

Tiffinshala maintains and displays Business Listings to help Users discover local businesses and service providers.

Business Listings may be created, updated, or maintained using information obtained from one or more of the following sources:

• Information voluntarily submitted by Business Owners through listing forms or registration processes.
• Information provided by authorized representatives of a Business.
• Information obtained from publicly available and lawful sources, including official business websites, Google Business Profiles, publicly accessible directories, social media business pages, advertisements, promotional materials, or other publicly available sources.
• Information collected through direct communication with Business Owners.
• Information updated or verified by Tiffinshala based on publicly available information or requests received from Business Owners.

Business Listings may include, where applicable:

• Business name
• Contact information
• Business address
• Location and service areas
• Business description
• Products or services offered
• Menus
• Accommodation details
• Amenities
• Pricing information
• Operating hours
• Delivery availability
• Photographs
• Videos
• Website links
• Social media links
• Government registrations or licenses voluntarily provided by the Business
• Customer reviews and ratings
• Any other information relevant to the Business.

While Tiffinshala makes reasonable efforts to maintain accurate and useful Business Listings, we do not warrant or guarantee that any Listing is complete, accurate, current, reliable, or continuously available.

Information displayed on the Platform may become outdated due to changes made by the Business, operational changes, or changes in publicly available information.

Business Owners are solely responsible for ensuring that the information relating to their Business is accurate, complete, lawful, and up to date.

The inclusion of a Business Listing on the Platform does not imply that Tiffinshala has verified, inspected, certified, approved, endorsed, recommended, or guaranteed the Business or any information contained in the Listing.

By accessing or using the Platform, you agree to use it responsibly, lawfully, and in accordance with these Terms.

You acknowledge and agree that you are solely responsible for evaluating the suitability of any Business before contacting, engaging, purchasing products or services, making payments, entering into agreements, renting accommodation, or otherwise transacting with a Business listed on the Platform.

Before engaging with any Business, you should independently verify, where applicable:

• Business identity and ownership.
• Products and services offered.
• Pricing and applicable charges.
• Availability.
• Delivery areas and timelines.
• Food ingredients and nutritional information.
• Allergens and dietary suitability.
• Hygiene and food safety practices.
• Accommodation quality and cleanliness.
• Amenities and facilities.
• Occupancy rules and house policies.
• Licenses, registrations, and statutory approvals.
• Payment methods.
• Cancellation, refund, and replacement policies.
• Any other information relevant to your intended transaction.

Users are encouraged to communicate directly with the Business to clarify any questions or concerns before making any purchase, booking, payment, or commitment.

You agree not to rely solely on the information displayed on the Platform when making decisions and acknowledge that Business information may change over time.

You are solely responsible for all decisions, communications, transactions, payments, bookings, rentals, purchases, or agreements made with any Business.

Tiffinshala shall not be responsible for any misunderstanding, dispute, financial loss, inconvenience, injury, damage, or claim arising from a User's interaction or transaction with any Business.

By submitting, claiming, managing, or maintaining a Business Listing on the Platform, you represent, warrant, and agree that:

• You are the lawful owner of the Business or are duly authorized to act on behalf of the Business.
• You have the legal authority to submit, publish, update, and manage the information relating to the Business.
• All information submitted to Tiffinshala is true, accurate, complete, lawful, and not misleading.
• You will promptly update your Business Listing whenever there are changes to your business information, products, services, pricing, contact details, operating hours, availability, or any other material information.
• You will comply with all applicable laws, regulations, licenses, registrations, and statutory requirements relevant to your Business.
• You will obtain and maintain all approvals, permits, registrations, certifications, and licenses required to operate your Business.
• You will ensure that all photographs, logos, menus, descriptions, videos, documents, and other content submitted to the Platform are owned by you or used with appropriate authorization and do not infringe the rights of any third party.
• You will not publish false, deceptive, misleading, offensive, unlawful, or fraudulent information on the Platform.
• You will respond to customer enquiries professionally and in accordance with applicable laws.
• You will honor the commitments, pricing, policies, and representations made to Users.

Businesses remain solely responsible for their operations, products, services, accommodation, food quality, hygiene, pricing, customer service, delivery, safety, cleanliness, occupancy rules, refunds, cancellations, warranties, and all other obligations arising from their business activities.

Tiffinshala is not responsible for monitoring or supervising the day-to-day operations of any listed Business.

The Platform, including its design, layout, user interface, software, source code, databases, search functionality, features, content, graphics, logos, trademarks, trade names, icons, text, images, videos, compilations, and all other materials made available by Tiffinshala (collectively, the "Platform Content"), are owned by or licensed to Tiffinshala and are protected under applicable intellectual property, copyright, trademark, and other proprietary laws.

Except as expressly permitted under these Terms or with the prior written consent of Tiffinshala, no person may:

• Copy, reproduce, modify, adapt, translate, or create derivative works from the Platform or Platform Content.
• Republish, distribute, transmit, display, perform, sell, license, or commercially exploit any part of the Platform.
• Reverse engineer, decompile, disassemble, or attempt to discover the source code of any software forming part of the Platform.
• Use automated tools, bots, crawlers, scrapers, or similar technologies to access, extract, monitor, or copy Platform Content without prior written authorization.
• Remove, alter, or obscure any copyright, trademark, or proprietary notices displayed on the Platform.

Business names, logos, trademarks, service marks, photographs, menus, accommodation details, and other intellectual property belonging to Businesses remain the property of their respective owners. The display of such materials on the Platform does not transfer any ownership rights to Tiffinshala or to Users.

By submitting any Business information, photographs, logos, menus, promotional materials, or other content to the Platform, the Business Owner represents that they possess all necessary rights and permissions to do so and grants Tiffinshala a non-exclusive, worldwide, royalty-free, transferable, sublicensable license to host, store, reproduce, modify, publish, display, distribute, and use such content solely for the purpose of operating, maintaining, improving, promoting, and providing the Platform and its Services.

Nothing contained in these Terms shall be construed as granting any license or right to use any intellectual property belonging to Tiffinshala or any third party except as expressly provided herein.

The Platform may permit Users and Business Owners to submit, upload, publish, or otherwise provide content, including but not limited to reviews, ratings, comments, photographs, videos, feedback, business descriptions, menus, accommodation details, responses, and other materials ("User Content").

You are solely responsible for all User Content that you submit or make available through the Platform.

By submitting User Content, you represent and warrant that:

• You own or have obtained all necessary rights, permissions, licenses, and consents to publish the User Content.
• The User Content is accurate, truthful, and not misleading.
• The User Content does not violate any applicable law, regulation, contractual obligation, or the rights of any third party.
• The User Content does not infringe any copyright, trademark, privacy, publicity, or other intellectual property rights.
• The User Content does not contain false, defamatory, abusive, obscene, discriminatory, threatening, fraudulent, misleading, unlawful, or offensive material.

By submitting User Content, you grant Tiffinshala a non-exclusive, worldwide, perpetual, irrevocable, royalty-free, transferable, and sublicensable license to use, host, store, reproduce, adapt, modify, publish, translate, distribute, publicly display, publicly perform, and otherwise use such User Content in connection with the operation, maintenance, promotion, improvement, and development of the Platform and related services.

Tiffinshala does not endorse, verify, guarantee, or assume responsibility for any User Content published by Users or Businesses. Opinions expressed in reviews, ratings, comments, or other User Content belong solely to the respective authors and do not necessarily reflect the views of Tiffinshala.

Tiffinshala reserves the right, but not the obligation, to monitor, review, edit, restrict, refuse, remove, or disable access to any User Content at its sole discretion and without prior notice where it reasonably believes that such content:

• Violates these Terms or any applicable law.
• Is false, misleading, fraudulent, or deceptive.
• Infringes the intellectual property or other legal rights of any person.
• Contains spam, malware, promotional abuse, or unauthorized advertising.
• Is abusive, defamatory, hateful, threatening, discriminatory, or otherwise objectionable.
• May expose Tiffinshala, Users, or Businesses to legal liability or reputational harm.

Tiffinshala is under no obligation to publish, retain, or restore any User Content and may remove or disable access to such content at any time.

Users acknowledge that reviews and ratings are subjective opinions and should not be relied upon as the sole basis for making purchasing, booking, rental, or other business decisions.

The Platform may contain links to, integrate with, or otherwise provide access to third-party websites, applications, services, maps, communication platforms, payment providers, social media platforms, or other external resources that are owned or operated by independent third parties.

These may include, but are not limited to:

• Google Maps
• Google Business Profiles
• WhatsApp
• Instagram
• Facebook
• YouTube
• LinkedIn
• Business websites
• Government websites
• Payment platforms
• Any other third-party services that may be introduced from time to time.

These third-party services are provided solely for the convenience of Users and Businesses.

Tiffinshala does not own, operate, control, monitor, endorse, certify, or guarantee any third-party website, application, product, or service.

Accordingly, Tiffinshala makes no representations or warranties regarding:

• The availability of third-party services.
• The accuracy or completeness of information provided by third parties.
• The security or privacy practices of third parties.
• The quality, reliability, legality, or suitability of third-party products or services.
• The continued availability of third-party integrations.

Your access to and use of any third-party website or service is entirely at your own risk and is governed solely by the applicable terms, conditions, and privacy policies of the respective third party.

Tiffinshala shall not be responsible or liable for any loss, damage, dispute, claim, or liability arising out of or relating to your use of or reliance upon any third-party website, application, service, or content.

Your privacy is important to us.

The collection, use, storage, disclosure, and protection of your personal information are governed by the Tiffinshala Privacy Policy, which forms an integral part of these Terms.

By accessing or using the Platform, you acknowledge that you have read and understood the Privacy Policy and consent to the collection, use, processing, and disclosure of your information in accordance with that policy and applicable law.

Where there is any inconsistency between these Terms and the Privacy Policy regarding the processing of personal information, the Privacy Policy shall prevail to the extent of such inconsistency.

Users and Businesses are responsible for ensuring that any personal information they submit to the Platform is accurate, lawful, and provided with all necessary consents where required.

Nothing in these Terms limits any rights or obligations provided under applicable data protection or privacy laws.

The Platform and all Business Listings, Content, and Services are provided on an "as is" and "as available" basis without any express or implied representation, warranty, or guarantee of any kind.

To the fullest extent permitted by applicable law, Tiffinshala expressly disclaims all warranties, representations, and conditions, whether express, implied, statutory, or otherwise, including but not limited to warranties of merchantability, fitness for a particular purpose, non-infringement, availability, accuracy, reliability, security, or uninterrupted operation of the Platform.

Tiffinshala is solely a technology-enabled hyperlocal business discovery, directory, and lead generation platform. We do not own, operate, manage, supervise, inspect, certify, endorse, or control any Business listed on the Platform unless expressly stated otherwise.

Accordingly, Tiffinshala does not warrant, represent, or guarantee:

• The quality, safety, freshness, taste, hygiene, ingredients, nutritional value, or suitability of any food or beverage.
• The cleanliness, safety, security, amenities, occupancy conditions, legality, suitability, or quality of any accommodation or property.
• The accuracy, completeness, reliability, legality, or timeliness of any Business Listing or Business information.
• The availability of any Business, product, accommodation, or service.
• The pricing, discounts, offers, promotions, or commercial terms published by any Business.
• The qualifications, licenses, registrations, certifications, approvals, or legal compliance of any Business.
• The conduct, behaviour, professionalism, integrity, or performance of any Business Owner, employee, representative, or User.
• The outcome, quality, or success of any communication, enquiry, booking, purchase, rental, or transaction between Users and Businesses.
• The accuracy, authenticity, or reliability of reviews, ratings, comments, photographs, or other User Content published on the Platform.

Business information displayed on the Platform may be obtained from Business Owners, publicly available sources, or other lawful sources. While Tiffinshala makes reasonable efforts to maintain accurate information, we do not guarantee that any information is complete, current, error-free, or continuously updated.

The inclusion of any Business on the Platform shall not be interpreted as an endorsement, recommendation, verification, certification, partnership, sponsorship, or approval by Tiffinshala.

Users are solely responsible for exercising their own judgment and conducting appropriate due diligence before engaging with any Business.

Tiffinshala does not guarantee that the Platform will always be available, uninterrupted, secure, error-free, or free from viruses, malware, or other harmful components.

The Platform may be temporarily unavailable due to maintenance, technical issues, upgrades, network failures, force majeure events, or circumstances beyond our reasonable control.

Nothing in this section excludes or limits any warranty or liability that cannot be excluded under applicable law.

To the fullest extent permitted by applicable law, Tiffinshala, its affiliates, directors, partners, officers, employees, agents, licensors, and service providers shall not be liable for any direct, indirect, incidental, consequential, special, exemplary, punitive, or economic damages, or any loss of profits, revenue, goodwill, business opportunities, data, reputation, or other intangible losses arising out of or relating to:

• Your access to or use of, or inability to access or use, the Platform.
• Any interaction, communication, enquiry, booking, purchase, rental, payment, or transaction between a User and a Business.
• The quality, safety, legality, availability, pricing, delivery, accommodation, cleanliness, hygiene, or suitability of any product or service offered by a Business.
• Any food-related illness, allergic reaction, contamination, injury, or health issue.
• Any accommodation-related dispute, property damage, theft, loss, personal injury, safety concern, or occupancy issue.
• Incorrect, incomplete, outdated, misleading, or publicly sourced Business information.
• Reviews, ratings, comments, photographs, or other User Content.
• Delays, cancellations, refunds, replacements, or disputes involving a Business.
• Unauthorized access to, alteration of, or loss of your information.
• Interruptions, technical failures, system outages, security incidents, or errors affecting the Platform.
• Any third-party website, application, payment provider, map service, communication platform, or external service linked to or integrated with the Platform.
• Any act, omission, negligence, misconduct, fraud, or unlawful conduct of any User or Business.

Users and Businesses acknowledge that Tiffinshala is not a party to any agreement or transaction between them and shall not be responsible for resolving disputes arising from such interactions.

You agree to defend, indemnify, and hold harmless Tiffinshala, its affiliates, partners, directors, officers, employees, agents, licensors, contractors, and service providers from and against any and all claims, demands, actions, proceedings, liabilities, damages, judgments, penalties, fines, losses, costs, and expenses (including reasonable legal fees and expenses) arising out of or relating to:

• Your use of or misuse of the Platform.
• Your violation of these Terms or any applicable law.
• Any information, content, review, photograph, or material submitted by you.
• Your infringement of any intellectual property, privacy, publicity, contractual, or other legal rights of any person or entity.
• Any transaction, agreement, dispute, or interaction between you and another User or Business.
• Any products or services offered by your Business.
• Any false, misleading, inaccurate, unlawful, or fraudulent information provided by you.
• Your failure to obtain any required licenses, registrations, approvals, or permissions.
• Your negligent acts, omissions, misconduct, or wilful misconduct.

Businesses further agree to indemnify and hold Tiffinshala harmless from any claims arising out of or relating to the operation of their Business, including but not limited to claims relating to food quality, hygiene, accommodation, pricing, delivery, customer service, statutory compliance, consumer complaints, refunds, cancellations, personal injury, property damage, or regulatory actions.

Tiffinshala reserves the right, at its own expense, to assume the exclusive defence and control of any matter subject to indemnification by you. In such circumstances, you agree to cooperate fully with Tiffinshala in the defence and resolution of the matter.

Where liability cannot be excluded under applicable law, Tiffinshala's aggregate liability for all claims arising out of or relating to the Platform shall be limited to the maximum extent permitted by applicable law.

Nothing in these Terms excludes liability that cannot legally be excluded or limited under applicable law.
